When Do Guaranteed Issue Rights Apply?

You may qualify for guaranteed issue in several common scenarios:

1. Losing Employer or Union Coverage

If your employer group plan, retiree plan, or COBRA coverage is ending, you qualify for GI rights to buy certain Medigap plans.

2. Your Medicare Advantage Plan Ends or Changes

You get guaranteed issue if:

  • Your Medicare Advantage (MA) plan leaves the service area

  • Your MA plan stops contracting with Medicare

  • You move out of your MA plan’s coverage area

3. Dropping a Medicare Advantage Plan in Your First Year
